I was out on Toronto Island last Monday and saw someone ice fishing 150 metres off of Wards Island. Realizing that the harbour rarely freezes completely over I decided to trek on out there and take a photo with the city as a backdrop. I posted it on Flickr and in a ton of Flickr groups...someone at The Star saw it and contacted me. For a paltry $100 it was theirs to use. I don't see it online but it IS on the front page of today's GTA section.

So who knows, a century from now when there's palm trees growing on Toronto Island people will scarcely believe Torontonians once ice-fished...or that there were even fish living in the lake.

I had his email address as I was going to send him a copy. I did let him now The Star might print it and he said he was 'stoked'. I took that as consent. But I assumed I didn't need his release because the photo was used for editorial purposes. Getty Images has invited me to submit it to them for sale on their site and I suppose I'd need a model release if the user wanted it for commercial non-editorial purposes.

But bottom line is I don't really know. I really just consider myself a hobbyist. Guess i should consider this if giving my photo makes me liable to something...thanks for asking. Perhaps people who sell photos for a living could chime in.

Not going to comment on Getty and what they're doing to photographers and pay (google it) but you should be able to mark it 'no commercia'l etc.. the onus will be on the photographer to make sure they have releases, liabilities fall on them as well if no release.

that's really cool --- actually the harbour did freeze completely a few years ago -- so this isn't the first time in recent years. I have several friends that live on the island.
