I am unsure of the legality of photo rights.

As some of you will remember, I had brought in a number of people to The Carlu for a photo opportunity. It seems like there is someone who has decided to list their photos taken here on a stock website and are selling the rights to use them. There are 9 in total.

Now, my question is, are they able to make a profit on these pictures without our permission?

I figured I would ask everyone here before heading to our lawyers.

Any release forms signed?

if there wasn't any, technically, the photog owns the photos. But you can "ask" to remove the photos from the stock site

You might think that ...... but there are issues with property rights. They are making money from the photos - thus they should technically have a property release.

agreed...

are there any "defining" images that would be unique to the The Carlu? like identifying features?

Ya, there are definitely unique features that make it obvious that it is The Carlu. There are 2 pictures that are similiar to our actual Marketing Stock Photos. There are a couple where it is a close up of an architectural detail and I can tell that it is The Carlu, the general public may not. However, in each picture "description" he says that it is The Carlu.

usually stock agencies/websites require property releases from photographers to sell images of famous/identifiable property that is protected by the owner. I am not associated with law in any way so I wouldn't quote me on that. As far as I know the photographer is free to sell the photos for editorial use without any release. If I was a Carlu owner/associate I'd definitely discuss this matter with a qualified lawyer

Hi Jen,
I was at one of the shoots and remember that you had a release form that photos would be for non commercial use only. However, if I remember correctly signing the release was left to individuals, maybe some people did not sign.

Thanks for the advise everyone!! I forgot how helpful everyone is on this site. Perhaps it's time to make a comeback :)

I called the stock website and talked to the owner...we've come to an agreeable course of action.
