I agree. There are boundaries. And I believe there are still many behaviors, that while not illegal, still fall outside the boundaries of ethical behavior. Taking a picture of someone in a public place = legal. therefore, photographing children playing in a public playground is not illegal. I still think it is ethical to ask their parents for permission. Taking a picture of someone in a public place = legal. Photographing sunbathers on the beach is not illegal. I still think standing over a sunbather and taking several photos of her sunbathing is not ethical. Should one not obtain their consent?
Clearly art is NOT without boundaries.

Honestly, I look at this THEME thread to see great photos of people, not argue ethics or legalities of same. I suggest having this sort of discussion on a separate thread. I believe IONS has already created one that would be applicable.
